1. Introduction

Welcome to Little Masters ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of the Little Masters website, platform, and related services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not use our Services.

2. Eligibility

  • You must be at least 18 years old or have parental/guardian consent to use our Services.
  • By using Little Masters, you confirm that any uploaded drawings are your property or that you have the legal right to upload them.

3. Account Registration

  • You may need to create an account to access certain Services.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must provide accurate and complete information during registration.

4. Use of Services

You agree to use the Services only for lawful purposes. You will not:

  • Upload any drawings, images, or content that:
    • Infringes on any third-party copyright, trademark, or intellectual property rights.
    • Contains violent, sexually explicit, abusive, or otherwise harmful material.
    • Exploits or depicts minors in any inappropriate or illegal way (this will result in immediate termination and referral to law enforcement).
  • Attempt to interfere with or disrupt the Services.
  • Use the Services for illegal, harmful, or exploitative purposes.

We reserve the right to remove any content that violates these Terms or applicable law.

5. Content Guidelines

You are solely responsible for the content you upload. By uploading, you confirm:

  • You have the legal right to upload the content.
  • The content complies with these Terms and applicable laws.

6. Payments and Refunds

  • Payments for Services (e.g., AI-generated artwork credits, prints) are due at the time of purchase.
  • All prices are listed in EUR and include applicable taxes unless stated otherwise.
  • All sales are final. We do not offer refunds, returns, or exchanges, except where required by law.

7. Intellectual Property of Little Masters

  • All non-user content on the platform (including text, graphics, branding, UI, and underlying technology) is owned by Little Masters and protected by copyright and trademark laws.
  • You may not copy, reproduce, or create derivative works from our platform materials except as permitted under these Terms.

8. License, Ownership, and Usage Rights

8.1 Ownership of Uploaded Drawings (User Content)

You retain full ownership of any drawings you upload to Little Masters ("User Content").

By uploading, you grant Little Masters a perpetual, worldwide, royalty-free, irrevocable license to:

  • Use, reproduce, display, and distribute your drawings to deliver Services.
  • Use your drawings in marketing, promotional materials, advertising, videos, social media, and other commercial contexts related to Little Masters.
  • Create derivative works (e.g., before/after showcases, collages).

8.2 Ownership of AI-Generated Artworks

Any AI-generated artwork created through Little Masters is jointly owned by you and Little Masters.

Both you and Little Masters may:

  • Use, reproduce, display, modify, and distribute the artwork.
  • Use it for personal and commercial purposes without seeking further permission.

You acknowledge that Little Masters may commercially exploit such artworks (ads, campaigns, branded products) without owing royalties or compensation.

8.3 Commercial Licensing and Third-Party Use

  • Little Masters may license, sublicense, or commercially exploit any AI-generated artwork, including granting rights to third parties (e.g., publishers, studios, brands).
  • Users hereby waive any claim to royalties, compensation, or approval rights regarding such third-party uses or licenses.
  • Your personal and small-scale commercial rights remain unaffected.

8.4 User Rights

You may:

  • Print, share, and display your drawings and generated artworks for personal use.
  • Use generated artworks for small-scale commercial purposes (e.g., gifts, posters, limited merchandise sales).

You may not:

  • Upload infringing, violent, or sexual content.
  • Claim exclusive ownership of generated artworks.
  • File takedowns or claims against Little Masters' use or licensing.
  • Use content for illegal, offensive, or harmful purposes.

8.5 Little Masters Rights

We may:

  • Use uploaded drawings and generated artworks for marketing, branding, and promotional purposes.
  • License or sublicense AI-generated artworks for commercial use, including to third parties such as publishers, studios, or brands.
  • Create derivative works (e.g., showcases, collages) for marketing or commercial contexts.
  • Retain content internally for backups and AI model improvement.

We will not:

  • Sell or license your original uploaded drawing (unaltered) as a standalone product disconnected from Little Masters or its derivative outputs.

8.6 Irrevocability and Governing Law

  • This license is perpetual, worldwide, royalty-free, and irrevocable once you upload content or generate artworks.
  • These Terms are governed by Dutch law, but apply globally under the Berne Convention.

9. Our Service Commitments

Little Masters provides an online platform for transforming uploaded drawings into AI-generated artworks and related digital services.

We aim to ensure:

  • Platform availability: Our Services are generally available 24/7 but may occasionally be interrupted for maintenance or technical issues.
  • Delivery of artworks: Generated artworks are delivered digitally via the platform, typically within minutes.
  • Support: We provide reasonable support via email at info@littlemasters.ai, with a typical response time of 2-3 business days.

Important disclaimers:

  • We do not guarantee that every generated artwork will meet your artistic or stylistic expectations.
  • Our Services are provided on an "as-is" basis. While we aim for high-quality outputs, AI-generated results are inherently variable.
  • We are not liable for delays, errors, or disruptions caused by circumstances beyond our reasonable control.

10. Privacy

We respect your privacy. Please review our Privacy Policy to understand how we handle your personal data.

11. Termination

Violation of Terms:

We may suspend or terminate your account immediately, without refund, if you:

  • Violate these Terms (including eligibility requirements).
  • Upload prohibited or unlawful content.
  • Misuse the Services in any way.

Upon termination, you lose access to your account and any unused credits. Licenses granted to Little Masters remain in effect.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Little Masters is not liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the amount paid by you for the Services in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Little Masters harmless from claims, damages, or expenses arising from:

  • Content you upload.
  • Your violation of these Terms.
  • Your misuse of the Services.

14. Modifications

We may update these Terms from time to time. Significant changes will be notified by email or platform notice. Continued use of the Services constitutes acceptance of the updated Terms.
